Overview

These Terms of Service ("Terms") govern your access to and use of the My Membership Club ("MMC") website and services, which are owned and operated by The Dispatcher LLC ("Company," "we," "us," or "our").

By accessing our website, creating an account, or purchasing any MMC subscription, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use our services.

1. Eligibility

By using our services, you represent and warrant that:

• You are at least 18 years of age.

• You have the legal authority to enter into this agreement.

• If registering on behalf of a business, you are authorized to bind that business to these Terms.

2. Description of Services

MMC is a subscription-based platform developed for cleaning businesses to help increase recurring revenue through membership management, customer communication, and service automation.

Depending on your selected subscription plan, services may include:

• Branded digital membership cards

• Automated reminders and customer follow-ups

• Priority service management tools

• Membership tracking

• Customer communication tools

• Additional features and services included in your selected plan

We reserve the right to modify, improve, or discontinue features at any time.

3. Subscription Plans and Billing

MMC currently offers the following subscription plans:

• Essential Plan: $299 USD per month

• Pro Plan: $499 USD per month

Subscriptions are billed monthly through Stripe.

By subscribing, you authorize The Dispatcher LLC to automatically charge your selected payment method on a recurring monthly basis until your subscription is cancelled.

You agree that:

• Your payment information will remain accurate and up to date.

• Failed payments may result in suspension or termination of your account.

• Prices may change with prior notice.

• Promotional pricing, if offered, may have separate terms.

4. Cancellation and Refund Policy

You may cancel your subscription at any time by contacting:

Upon cancellation:

• Your subscription remains active until the end of the current billing period.

• No partial or prorated refunds will be issued.

• Future recurring charges will stop after the current billing cycle.

• Account data will generally be retained for up to 90 days before permanent deletion unless required by law.

5. SMS Terms

By providing your mobile phone number, you consent to receive automated transactional and promotional SMS messages from The Dispatcher LLC.

• Consent is not a condition of purchase.

• Message frequency varies.

• Message and data rates may apply.

• Reply STOP to unsubscribe.

• Reply HELP for assistance.

• Mobile carriers are not responsible for delayed or undelivered messages.

6. Customer Responsibilities

You agree to:

• Use MMC only for lawful business purposes.

• Maintain accurate account information.

• Protect your account credentials.

• Comply with all applicable federal, state, and local laws.

If you use MMC to communicate with your own customers, you are solely responsible for complying with all applicable communication laws, including but not limited to:

• Telephone Consumer Protection Act (TCPA)

• CAN-SPAM Act

• Applicable privacy laws

You are responsible for obtaining all legally required customer consents before sending automated communications through MMC.

7. Intellectual Property

MMC, including its software, branding, logos, content, documentation, technology, graphics, and website, is owned exclusively by The Dispatcher LLC and is protected under applicable intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the services solely for your own business.

You may not:

• Copy or reproduce the platform

• Resell the service without authorization

• Reverse engineer the software

• Create derivative works

• Remove copyright or proprietary notices

8. Limitation of Liability

To the maximum extent permitted by law, The Dispatcher LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the MMC platform.

Our maximum aggregate liability shall not exceed the total subscription fees you paid during the one (1) month immediately preceding the event giving rise to the claim.

9. Disclaimer of Warranties

MMC is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding uninterrupted availability, merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms.

• You engage in fraudulent or unlawful activity.

• Required subscription payments are not received.

Termination does not relieve you of payment obligations incurred before termination.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Wyoming and the applicable laws of the United States, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms periodically.

Updated versions will become effective immediately upon posting to our website unless otherwise stated. Continued use of MMC after changes become effective constitutes your acceptance of the revised Terms.
